Terms of Service

1. ACCEPTANCE OF TERMS

These Terms of Service ("Terms") are a binding agreement between you and the operator of RandomSaga ("RandomSaga," "we," "us," or "our"). They cover https://randomsaga.com; associated community, account, publishing, and roleplaying services; and any official RandomSaga Windows, Android, and iOS applications, installers, updates, or other client software we make available (collectively, the "Service" or "RandomSaga Software," as the context requires).

By accessing, registering for, purchasing a membership, installing, or using the Service, you represent that you have read, understand, and agree to these Terms and any policies expressly incorporated by reference, including our Privacy Policy. If you do not agree, you must not use the Service or install the Software.

If you use the Service on behalf of a business or other entity, you represent that you are authorized to bind that entity to these Terms. Where applicable, "you" includes that entity.

2. ADULTS ONLY: ELIGIBILITY AND AGE RESTRICTIONS

2.1. You must be at least 18 years old and meet any higher age of majority or other eligibility requirement applicable where you live to use the Service. No exceptions or parental-permission alternative are offered to minors.

2.2. By accessing or using the Service, you affirm that you meet these requirements and that viewing adult-oriented fictional content is lawful where you are located.

2.3. You must not provide false age or identity information, help a minor obtain access, share your account with a minor, or use the Service for the benefit of a minor.

2.4. We may restrict access, request age verification, use age-assurance measures, or suspend accounts where necessary to comply with applicable law or enforce these Terms. We do not guarantee that a particular age-checking method independently satisfies every jurisdiction's legal requirements.

2.5. If we learn or reasonably believe that a user is underage, we may promptly suspend or terminate access and delete or preserve associated information as permitted or required by law.

3. DESCRIPTION OF THE SERVICE AND LAUNCH MODEL

3.1. RandomSaga is an adults-only roleplaying community focused on entertainment and creative participation. Members can discover, create, share, publish, and play fictional scenarios, characters, and stories for fun, subject to available features and these Terms. The Service may include profiles, descriptions, user-created prompts and artwork, feeds, community features, and AI-assisted roleplaying interfaces.

3.2. At launch, RandomSaga operates as a "Bring Your Own Key" ("BYOK") platform. RandomSaga provides community features and software interfaces that may allow you to connect a compatible independent AI provider using your own account, API key, or other authorized credentials. RandomSaga is not, at launch, selling or including AI model access, API credits, tokens, inference usage, or an AI-provider subscription as part of its annual membership. You are responsible for separately obtaining and paying for the AI services you choose to use. Details appear in Section 9.

3.3. RandomSaga may develop and release official applications for Windows, Android, and iOS. A paid membership includes access to supported official applications once and where they become available, subject to Section 10, device compatibility, and any applicable app-store rules. No particular application, feature, release date, geographic availability, or store approval is guaranteed.

3.4. Scenarios, characters, and interactions generally come from community creators or connected AI services, not from verified RandomSaga editorial sources. RandomSaga does not endorse or verify every scenario. All roleplaying activities are intended for fictional, recreational use, not as professional advice or a guarantee of any outcome.

3.5. Creators do not receive compensation or commercial rights from RandomSaga merely by contributing, sharing, featuring, or winning recognition for a scenario. Any future paid creator program or other material feature will require separate disclosures or terms as applicable.

4. ACCOUNTS AND SECURITY

4.1. You agree to provide accurate registration information and keep it reasonably current.

4.2. You are responsible for keeping your credentials confidential and for activities conducted through your account, except to the extent caused by our own misconduct or as otherwise provided by law.

4.3. Do not sell, transfer, or share account access without our prior written permission. Notify us promptly at support@randomsaga.com if you suspect unauthorized use.

4.4. We may enforce reasonable account, rate, storage, and usage limits to protect security and the stability of the Service.

4.5. Access to the member-only website, community features, and RandomSaga Software requires a current, paid, active membership in good standing. Creating an account, possessing an installer, downloading a mobile application, or owning a third-party AI key does not itself grant continuing access after membership ends. The separate license and access provisions in Sections 10 and 16 apply.

5. NSFW CONTENT, MANDATORY LABELING, AND FEED FILTERS

5.1. Adult fictional content may be permitted on RandomSaga only when it complies with these Terms, applicable law, and the absolute prohibitions in Section 6. An "NSFW" label is not permission to post otherwise prohibited content.

5.2. Creators MUST turn on the NSFW or adult-content toggle before publishing or making available any scenario that contains or is intended to generate explicit sexual themes, erotic roleplay, nudity, pornographic descriptions, or similarly mature material. Creators must also apply the label to graphic violence or other material that RandomSaga requires to be labeled NSFW. The classification must cover the scenario as a whole, including its title, summary, prompts, previews, artwork, and likely interactions.

5.3. Creators may not evade this requirement through misleading titles, previews, tags, images, or descriptions. If a scenario is substantially changed so that it becomes NSFW, the creator must update its label before continuing to make it available. If a creator is uncertain, the creator should use the more protective classification or refrain from publishing until the content can be classified accurately.

5.4. RandomSaga provides an adult-content preference or filtering mechanism intended to keep properly labeled NSFW scenarios out of the discovery feed of users who choose not to see them. Creators are responsible for accurate labeling. We may relabel, restrict, suppress, or remove scenarios that are incorrectly marked. Because content is user-generated and classification may be imperfect, we cannot promise that every objectionable or mislabeled item will always be excluded from every search result, recommendation, link, or other part of the Service.

5.5. Users who do not wish to see NSFW material should keep the relevant viewing preference disabled and report material that appears to be improperly labeled. All users, including users who enable NSFW material, must still be adults aged 18 or older.

6. ABSOLUTELY PROHIBITED CONTENT AND ACTIVITIES

The following restrictions apply to all public and nonpublic uses of RandomSaga, including scenario content, prompts, private or unpublished drafts, profile information, comments, images, AI-assisted requests, and attempts to obtain content through the Service. Fictional framing, AI generation, disclaimers, roleplay, or an NSFW label do not create an exception.

6.1. Sexualization of minors. You may not create, request, upload, distribute, depict, promote, or attempt to generate sexual content involving anyone under 18, whether a real person, fictional character, illustrated or animated character, AI-generated person, or other representation. This includes child sexual abuse material; sexualized descriptions, images, or roleplay involving minors; sexual activity with a character presented as under 18; and characters whose age is ambiguous or who are reasonably depicted as children. Calling a childlike character "actually 18," "aged up," or an older age does not override their underage presentation or context. This prohibition applies regardless of whether a real child was used to create the material.

6.2. Bestiality and sexualized animals. You may not create, request, depict, promote, or distribute sexual activity involving animals, or material that sexualizes animals, whether real, fictional, illustrated, or AI-generated.

6.3. Sexualization of real people and sexual deepfakes. You may not create, request, upload, publish, impersonate, or distribute sexualized or intimate depictions of identifiable real people, including celebrities, public figures, other users, or private individuals. This includes nonconsensual intimate imagery, sexual deepfakes, realistic lookalikes, manipulated photos or videos, AI-generated intimate images, and text or roleplay that sexualizes an identifiable real person. The restriction applies even when the person is famous or the material is labeled fictional, parody, or AI-generated. Do not use another person's name, voice, face, or other likeness to evade this rule.

6.4. Other illegal or abusive activity. You may not use RandomSaga to engage in or facilitate unlawful conduct, sexual exploitation, grooming, trafficking, extortion, stalking, credible threats, targeted harassment, discriminatory abuse prohibited by law, doxxing, invasion of privacy, fraud, or the unauthorized disclosure of personal or confidential information.

6.5. Harmful technical activity. You may not distribute malware, exploit vulnerabilities, bypass security or safety measures, access other accounts without authorization, scrape the Service in violation of applicable law or technical restrictions, use automation that disrupts the Service, or interfere with its normal operation.

6.6. Intellectual property violations. You may not post material that infringes another person's copyright, trademark, privacy, publicity, or other legal rights, or use another creator's scenario without necessary authorization.

6.7. Evasion. You may not circumvent content labels, bans, blocked content, safety measures, reporting systems, or account restrictions, including by creating additional accounts.

6.8. AI-generated images only; no real images. All images submitted or displayed by users on RandomSaga must be created entirely using generative AI. This includes scenario covers, character portraits, profile pictures, avatars, banners, thumbnails, image attachments, and images included in posts, prompts, messages, and drafts. Users may NOT upload, submit, embed, or publish real photographs or images captured from the real world, including camera or phone photographs, selfies, screenshots, video frames, scans, stock photography, or photographs edited with filters, retouching software, or AI tools. Images derived from, incorporating, or manipulating an actual photograph or the recognizable face, body, or likeness of a real person are prohibited. Merely applying an AI filter, face swap, or image-editing process to a real image does not make it permitted. This restriction applies even to nonsexual images and even when the image is properly marked NSFW.

6.9. Fictional AI imagery only. Photorealistic images may be permitted if they are wholly AI-generated, depict fictional subjects, and comply with every other rule in these Terms. AI-generated images depicting or resembling identifiable real people are not permitted, and Section 6.3 separately prohibits sexualized depictions of real people in any medium. Sexually explicit depictions of minors, including fictional or AI-generated minors, and bestiality remain strictly prohibited under Sections 6.1 and 6.2. An NSFW designation never overrides any of these rules.

We may remove or restrict other content when reasonably necessary to protect users, enforce these Terms, meet legal obligations, or address material risks to the Service. Not every form of mature fictional storytelling is necessarily prohibited; however, all published content must comply with the rules above.

7. USER-GENERATED CONTENT AND CREATOR RESPONSIBILITY

7.1. "User Content" includes any scenario, world, character, prompt, message, text, artwork, image, description, rating, feedback, or other material you submit or make available through RandomSaga.

7.2. As between you and RandomSaga, you are solely responsible, to the fullest extent permitted by applicable law, for User Content that you upload, submit, create, request, publish, transmit, or otherwise make available through the Service, whether public, private, unpublished, AI-assisted, or AI-generated. This responsibility includes evaluating the content's legality, obtaining all necessary rights and permissions, correctly setting the NSFW toggle, complying with the AI-only image rule and all other content standards, and addressing consequences arising from your submissions or conduct. You represent and warrant that your User Content and its submission and use through the Service comply with these Terms and applicable law, and that you have all rights needed to submit it and grant the license below. Your use of an AI generator does not excuse infringements or other violations. Nothing in this provision shifts to you legal obligations that applicable law independently imposes on RandomSaga.

7.3. You retain whatever ownership rights you lawfully hold in your User Content. Submission does not transfer ownership to RandomSaga.

7.4. By submitting User Content, you grant RandomSaga a non-exclusive, worldwide, royalty-free license, with the right to authorize our service providers as needed, to host, store, reproduce, process, format, adapt for technical presentation, display, distribute, and otherwise use the User Content solely for operating, maintaining, protecting, improving, and promoting the Service and the content as made available by you, consistent with your privacy and publication settings. This license lasts while the content is hosted or used for those purposes, and for a reasonable time thereafter for backups, legal compliance, safety investigations, and already-authorized uses, to the extent permitted by law.

7.5. Publicly shared content may be seen, linked to, discussed, or used within available platform features by other users. Do not publish material you are unwilling to make available under the visibility setting you select.

7.6. Deleting content or an account may stop future public display but does not necessarily remove material from backups, records retained for lawful reasons, or copies lawfully obtained outside the Service. We will process deletion requests according to our Privacy Policy and applicable law.

7.7. RandomSaga is not obligated to publish, keep, promote, feature, or pay for any User Content. Recommendations, rankings, and community awards do not imply approval of all aspects of a creator's work.

7.8. Image-source certification. Every time you submit an image, you represent and warrant that the image was generated entirely by AI; is not a real photograph, a real image modified by AI, or a depiction of an identifiable actual person; and is otherwise lawful and permitted under these Terms. You also represent that you have the rights and permissions required by any applicable AI-tool terms and other laws. If you cannot reasonably verify that an image meets these rules, do not submit it. We may request information about an image's origin, reject or remove images when their source is uncertain, and suspend or terminate accounts for violations, subject to applicable law.

7.9. Creator accountability and platform discretion. RandomSaga provides hosting and creation tools but does not thereby adopt, endorse, verify, or become the author of content submitted by users. Our choice to review, filter, label, feature, reject, or remove an item does not release its creator from responsibility for that item. We may take reasonable steps to enforce these rules and respond to reports, and we will comply with legal duties applicable to us. These Terms do not remove or waive those duties.

8. AI-ASSISTED ROLEPLAY AND FICTIONAL OUTPUT

8.1. AI outputs produced through a connected provider may be probabilistic, inaccurate, inconsistent, offensive, infringing, or otherwise unsuitable. You are responsible for reviewing content before publishing or acting on it and must not request, generate, or share content that these Terms prohibit. Fictional scenarios, characters, dialogue, and interactions do not constitute real relationships or communications.

8.2. An AI provider's model and moderation policies may prevent certain content, including lawful adult fiction. RandomSaga does not promise that any particular provider will generate NSFW output or support any model, feature, request, or scenario, and you must not use RandomSaga to bypass a provider's access controls or safety restrictions.

8.3. AI-generated output is not professional advice, verified fact, or a promise of a particular result. We do not warrant that it is unique, copyrightable, noninfringing, eligible for legal protection, or free of third-party claims. Any rights in AI output depend on applicable law and relevant third-party terms.

8.4. Before publishing any generated image, you must ensure that it is entirely AI-generated, depicts only permitted fictional subjects, and otherwise satisfies Sections 5 through 7. A third-party AI system's willingness to generate content does not mean the content is permitted on RandomSaga.

9. BRING YOUR OWN KEY (BYOK) AND THIRD-PARTY AI PROVIDERS

9.1. Separate provider relationship. To use AI-dependent features at launch, you must obtain lawful access to a compatible AI service from an independent provider of your choice, subject to the providers and connection methods then supported by RandomSaga. Your relationship with the provider is separate from your RandomSaga membership. You are solely responsible for reviewing and complying with that provider's terms, policies, age restrictions, billing arrangements, limits, and technical requirements.

9.2. Separate costs. The USD $12.00 annual RandomSaga membership pays for eligible RandomSaga platform and software access, not for AI generation. Any provider account fees, API requests, usage charges, tokens, credits, subscriptions, minimum charges, overages, taxes, or other provider costs are separate and are your responsibility. RandomSaga does not set or control independent providers' prices, and the provider may bill you even when an AI response fails, is filtered, or is not saved by RandomSaga, depending on the provider's terms.

9.3. Authorized credentials and security. You must use only AI accounts, keys, and credentials that you own or are authorized to use. Keep them secure; do not publish keys in a public scenario, prompt, comment, image, profile, or shared content. You are responsible for managing, restricting, rotating, revoking, and monitoring your credentials and provider usage. If you suspect misuse, promptly take appropriate steps with your provider. Do not share someone else's keys or use RandomSaga to defeat provider security, usage restrictions, or content rules.

9.4. Provider processing and privacy. To operate BYOK features, the selected integration may transmit prompts, scenario context, message history, instructions, and related data to the provider you connect. That provider may process, store, retain, review, or use the data according to its own terms and privacy policy. Do not submit sensitive personal or confidential information to a provider without appropriate authorization. RandomSaga's own handling of credentials and data must be described accurately in its separate Privacy Policy and applicable in-product disclosures; these Terms do not promise that keys are never stored or that prompts are never transmitted or logged.

9.5. Provider availability and limits. We do not control independent providers' models, API availability, pricing, output restrictions, outages, delays, rate limits, account suspensions, or changes to terms. Providers and integrations may be added, changed, deprecated, or removed. You are responsible for selecting a compatible provider and understanding its limitations. RandomSaga does not guarantee continued compatibility with any particular provider.

9.6. No bundled AI service at launch. Unless RandomSaga clearly offers a different paid or included AI feature in the future under disclosed terms, no membership charge entitles you to AI tokens, model usage, an API key issued by RandomSaga, or reimbursement of third-party provider charges. A membership can remain active while a particular BYOK provider is unavailable; any applicable nonwaivable consumer rights still apply.

9.7. Your compliance. You are responsible for content you request, submit, or publish through a connected AI provider, including NSFW designations, image-origin requirements, and the prohibitions in Section 6. RandomSaga may disconnect or limit integrations that pose security, abuse, operational, or legal risks, subject to applicable law.

10. LIMITED SOFTWARE LICENSE; ACTIVE MEMBERSHIP REQUIRED

10.1. Included access during active membership. Subject to payment, compliance with these Terms, technical requirements, and any applicable store conditions, a current, paid, active RandomSaga member in good standing is granted a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the RandomSaga website's member-only features and to download, install, and use official RandomSaga Windows, Android, and iOS applications as each application is actually released and made available to that member. No separate perpetual ownership of the Software is sold or transferred.

10.2. Future releases not guaranteed. A membership does not guarantee that a Windows, Android, or iOS app exists today or will be released by any particular date. Releases, compatibility, geographic distribution, features, availability, and app-store acceptance may vary. "Included" means that the member's RandomSaga license covers supported apps when available, not that any app will necessarily launch, remain listed, function on every device, or avoid separately billed third-party costs.

10.3. Membership expiration, nonpayment, and termination. THE LICENSE TO USE RANDOMSAGA SOFTWARE AND THE RIGHT TO ACCESS MEMBER-ONLY RANDOMSAGA SERVICES EXIST ONLY WHILE YOUR MEMBERSHIP IS ACTIVE AND IN GOOD STANDING. If the paid membership expires, is not renewed, is terminated, or is suspended for an enforceable reason, the corresponding right to use all RandomSaga Software and member-only services ceases or is suspended, as applicable. This includes official Windows, Android, and iOS apps even if previously downloaded or installed. You must stop using the Software after the license ends; RandomSaga may require sign-in, validate membership status, and disable functionality or deny authentication. Access may resume after an eligible membership is restored, subject to these Terms and software availability.

10.4. Cancellation versus expiration. Canceling automatic renewal does not, by itself, end an otherwise active, paid membership before the end of its already-paid term. Unless an account is lawfully suspended or terminated earlier, the software license continues until that paid term ends, then expires if the membership is not renewed. See Section 16.

10.5. License restrictions. Except to the extent mandatory law permits otherwise, you may not sell, sublicense, rent, distribute, modify, make unauthorized copies of, reverse engineer, decompile, create derivative works from, tamper with license checks or membership authentication for, or commercially exploit RandomSaga Software; nor may you bypass access restrictions or use unofficial modified clients to avoid membership rules. You may retain only copies and backups that applicable law expressly permits.

10.6. App-store and device terms. An official mobile app, if offered, may be distributed subject to additional terms imposed by Apple, Google, or another applicable distributor, and features or purchasing options may differ as required by platform policies and applicable law. RandomSaga's membership terms do not override a store's mandatory rules, refunds, purchase terms, or the consumer's nonwaivable rights. Your AI-provider subscription, device, operating system, data connection, and any third-party fees are separate from the RandomSaga license.

10.7. Rights reserved. RandomSaga and its licensors retain all ownership and intellectual-property rights in the Software. Rights not expressly granted remain reserved. Any mandatory software-use rights under applicable law are unaffected.

11. CONTENT REVIEW, REPORTS, AND ENFORCEMENT

11.1. We may, but are not generally obligated to, review, classify, moderate, restrict, remove, or preserve content or accounts through automated methods and/or human review, to the extent permitted by law. We do not promise to monitor all content or discover every violation.

11.2. At our reasonable discretion and subject to applicable law, we may issue warnings, correct NSFW labels, reduce visibility, disable publication, remove content (including photographs, AI-edited real images, or AI-generated images that violate these Terms), request proof of AI-generated origin, suspend features, suspend or terminate accounts, prevent repeat registrations, and report potentially illegal material to appropriate authorities or child-protection organizations.

11.3. Certain urgent reports, including suspected child sexual exploitation or nonconsensual intimate imagery, may require priority action or disclosure as required or permitted by law. Do not submit or redistribute illegal material when making a report; provide links, descriptions, or other information sufficient to locate it whenever possible.

11.4. Users may report content or accounts through any available in-product reporting feature or by emailing support@randomsaga.com. Reports should identify the material, where it appears, why it may violate these Terms, and a way to respond when appropriate. Reporters do not need a RandomSaga account to contact us by email.

11.5. We may act on reports without prior notice when necessary. Where feasible and appropriate, we may permit users to request review of an enforcement decision at support@randomsaga.com. An appeal does not guarantee restoration.

12. NONCONSENSUAL INTIMATE IMAGERY: REMOVAL REQUESTS

RandomSaga prohibits nonconsensual intimate visual depictions, including digital forgeries and AI-generated sexual deepfakes of identifiable individuals. An affected person, or someone authorized to act for them, may request removal without opening a RandomSaga account.

To submit a written request, email support@randomsaga.com with the subject "Intimate Image Removal Request" and provide:

• (a) Your physical or electronic signature, or that of a person authorized to act on your behalf;
• (b) The URL or a description reasonably sufficient for us to locate the intimate image or video;
• (c) A brief statement that you have a good-faith belief the material depicts you and was published without your consent, including relevant facts supporting that belief; and
• (d) Contact information sufficient for us to communicate with you or your authorized representative.

We will handle valid requests in accordance with applicable law. Where RandomSaga is a covered platform under the U.S. TAKE IT DOWN Act, we will remove a qualifying intimate visual depiction as soon as possible, and no later than 48 hours after receiving a valid request, and make reasonable efforts within that period to identify and remove known identical copies. We may seek clarification if the information supplied is insufficient to identify or locate the material. We may also remove material sooner under our own policies, even if a particular statute does not apply.

We may preserve necessary evidence or disclose information when authorized or required by law, while restricting public access to the material. False or malicious reports are prohibited. For urgent safety concerns, also contact the appropriate local authorities.

13. COPYRIGHT AND DMCA NOTICES

We respect intellectual property rights and may remove allegedly infringing content or terminate repeat infringers in appropriate circumstances. A copyright holder or authorized representative may send a written copyright infringement report to support@randomsaga.com with:

• (a) A physical or electronic signature of the copyright owner or an authorized agent;
• (b) Identification of the copyrighted work allegedly infringed;
• (c) Identification of the allegedly infringing material and reasonably sufficient information to locate it;
• (d) Your name and contact information, including an email address and available mailing address or telephone number;
• (e) A statement that you have a good-faith belief that the complained-of use is not authorized by the owner, its agent, or the law; and
• (f) A statement, under penalty of perjury, that the notice is accurate and that you are authorized to act for the owner.

If we remove content following a copyright notice, the affected user may be entitled to send a counter-notification meeting applicable statutory requirements, including a signature, identification of the removed content, a statement under penalty of perjury that removal resulted from mistake or misidentification, their name, address, telephone number, and the required consent to jurisdiction and service of process. We will follow the applicable statutory process, including restoration where required.

Copyright infringement reports and counter-notifications may be sent to support@randomsaga.com. This email contact does not itself constitute a designated agent registration under U.S. copyright law. Where applicable, RandomSaga must separately satisfy all requirements for DMCA safe-harbor eligibility, including proper designation and public posting of a registered agent's contact information.

14. RANDOMSAGA BRAND AND PLATFORM RIGHTS

The Service, including RandomSaga Software, source code, original site design, interfaces, logos, names, and platform materials, is owned by RandomSaga or its licensors and protected by applicable intellectual-property laws. Except for the conditional, active-membership license expressly granted in Section 10, no license or ownership interest in our intellectual property is granted. You may not copy, resell, rent, sublicense, commercialize, or distribute the underlying Software or our branding without written permission, except as mandatory law permits. Community creators' separate rights in their permitted User Content remain subject to Section 7.

15. THIRD-PARTY SERVICES AND LINKS

The Service may contain third-party links or use independent hosting, payment, authentication, app stores, moderation services, or AI technologies. BYOK AI providers are independent services covered by Section 9. RandomSaga does not control their pricing, moderation, uptime, data practices, account eligibility, or terms. Your participation may result in charges to those third parties in addition to the RandomSaga membership fee. We are not responsible for the independent acts or omissions of third parties we do not control, except to the extent applicable law provides otherwise. Review each provider's terms and privacy notices.

16. PAID MEMBERSHIPS; USD $12 ANNUAL AUTOMATIC RENEWAL

16.1. Annual membership and what it includes. RandomSaga membership costs USD $12.00 per 12-month membership period, plus any applicable taxes disclosed at checkout. An active paid membership provides eligible access to the RandomSaga website's member-only service and a limited license for official Windows, Android, and iOS applications if and when they are released and made available, as detailed in Section 10. AI model access, API keys, credits, tokens, provider subscriptions, and provider usage charges are NOT included in this $12 membership at launch; you must separately arrange and pay for your own provider under Section 9. Any publicly accessible pages or expressly identified free features are separate and may be limited.

16.2. Automatic renewal and recurring charges. YOUR $12.00 ANNUAL MEMBERSHIP AUTOMATICALLY RENEWS FOR SUCCESSIVE 12-MONTH TERMS UNLESS YOU CANCEL BEFORE THE NEXT RENEWAL. By purchasing after clear disclosure of recurring terms and affirmatively authorizing recurring billing, you authorize RandomSaga or the authorized purchase processor to charge the payment method you select USD $12.00, plus applicable taxes, initially and again at each annual renewal until canceled. Your billing record or purchase confirmation will identify the renewal date and amount. We will obtain any consent required by law.

16.3. How to cancel. For subscriptions billed directly by RandomSaga or its website payment processor, you may request cancellation of future renewal by emailing support@randomsaga.com from the email associated with your account, and may use any account-based online cancellation mechanism we make available or are required to offer. We will provide cancellation methods and confirmation as required by applicable law. If a future app-store purchase is processed and billed by Apple, Google, or another distributor, you may need to cancel through that distributor's subscription-management process; the purchase screen and receipts should tell you who bills you. Contact support@randomsaga.com for help identifying the billing channel. Cancel before the renewal date to avoid the next charge, subject to your statutory rights.

16.4. Effect of cancellation, expiration, or payment failure. Canceling automatic renewal stops future renewals but ordinarily leaves your current paid membership active until the end of the already-paid term, unless terminated earlier for a legally valid reason. Upon expiration of that paid term without renewal, or upon a lawful suspension or termination, access to all member-only RandomSaga website features and the license to use all RandomSaga Software (including any previously downloaded Windows, Android, or iOS app) ends or is suspended under Section 10. Failed, reversed, or disputed payments may also lead to suspension or expiration, subject to applicable law. Cancellation does not necessarily delete your user account or published content; ask support@randomsaga.com about account deletion.

16.5. Refunds. Except where required by law or expressly stated in a purchase-specific offer, annual fees for a membership term that has already begun are not refundable or prorated solely because you cancel early, do not use the Service, lack a compatible AI provider, or cease using an app. This does not override statutory rights or mandatory distributor refund terms.

16.6. Disclosures, reminders, and receipts. We will provide subscription disclosures, billing receipts, renewal reminders, price-change notices, and cancellation information as required by applicable law. These Terms do not replace clear checkout disclosures or any consent required before charging a recurring fee.

16.7. Price changes. The membership price is USD $12.00 per year unless and until we disclose a future price change with any legally required notice and consent. You can cancel before a renewal at an increased rate. Third-party AI providers separately control their own prices and invoices.

16.8. Suspension, deletion, and recurring billing. If an account is restricted or terminated due to a violation, any refund rights are subject to applicable law and the stated refund terms. Do not treat account deletion, uninstalling an application, or losing access as confirmation that an automatically renewing subscription has been canceled. Request and retain cancellation confirmation.

17. AVAILABILITY, CHANGES, AND TERMINATION OF THE SERVICE

We may update, replace, pause, or discontinue features, integrations, platform support, or apps for security, operational, legal, or business reasons, subject to applicable consumer rights and any required notices. At launch, useful AI roleplay may depend on your independent BYOK provider's availability, pricing, account, model capabilities, and moderation restrictions. Outages, errors, provider interruptions, device incompatibility, and data loss may occur. Keep independent backups of your important User Content and avoid relying on the Service as your only copy.

You may stop using the Service at any time and may request account deletion at support@randomsaga.com. If you have an automatically renewing membership, follow Section 16 to cancel future renewal; uninstalling an app or deleting an account does not automatically cancel a third-party-billed subscription. We may restrict or terminate access for violations, safety or legal concerns, fraudulent activity, or prolonged inactivity, subject to applicable law. The license and access rights in Section 10 cease or are suspended when your paid membership ends or is lawfully suspended. Provisions that reasonably need to survive termination, including intellectual-property rights, certain content licenses, disclaimers, liability limitations, and indemnification, survive to the extent permitted by law.

18. PRIVACY AND DATA HANDLING

Our separate Privacy Policy, when posted on the Service, must accurately explain how RandomSaga collects, uses, secures, stores, discloses, and retains personal information, content, and any AI-provider credentials used with BYOK integrations, and explain applicable user rights. When you connect an external AI provider, prompts, scenario content, context, and messages may be sent to that provider to fulfill your request and may be subject to the provider's independent privacy terms. Do not assume communications with a third-party model are private or confidential. These Terms do not substitute for a complete and accurate Privacy Policy or for disclosures or consents that applicable law requires.

19. DISCLAIMERS

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE, RANDOMSAGA SOFTWARE, THIRD-PARTY INTEGRATIONS, AND AVAILABLE FEATURES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, UNINTERRUPTED OPERATION, ERROR-FREE PERFORMANCE, OR COMPATIBILITY WITH ANY PARTICULAR AI PROVIDER, DEVICE, OR OPERATING SYSTEM. WE DO NOT GUARANTEE THAT ANY WINDOWS, ANDROID, OR IOS APP WILL BE RELEASED ON A PARTICULAR DATE OR APPROVED BY A PLATFORM DISTRIBUTOR. WE DO NOT PROVIDE INCLUDED AI GENERATION CREDITS OR ASSUME RESPONSIBILITY FOR AN INDEPENDENT PROVIDER'S CONTENT, POLICIES, RATE LIMITS, OR FEES.

WE DO NOT ENDORSE, VERIFY, OR GUARANTEE USER CONTENT OR AI-ASSISTED OUTPUT. WE DO NOT GUARANTEE THAT NSFW LABELS, FEED FILTERS, IMAGE-ORIGIN CHECKS, OR MODERATION WILL BLOCK EVERY VIOLATION. THIS SECTION DOES NOT EXCLUDE LIABILITY OR NONWAIVABLE CONSUMER RIGHTS THAT APPLICABLE LAW PROHIBITS US FROM EXCLUDING.

20. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RANDOMSAGA AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOST BUSINESS OPPORTUNITIES, INDEPENDENT AI-PROVIDER FEES, OR INTERRUPTIONS OR CHANGES IN THIRD-PARTY AI SERVICES, ARISING OUT OF THE SERVICE, EVEN IF ADVISED SUCH DAMAGES WERE POSSIBLE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RANDOMSAGA'S TOTAL AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) USD $100 OR (B) THE AMOUNTS YOU PAID DIRECTLY TO RANDOMSAGA FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

THESE LIMITS DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED, INCLUDING WHERE RELEVANT FRAUD, WILLFUL MISCONDUCT, GROSS NEGLIGENCE, PERSONAL INJURY, OR MANDATORY STATUTORY RIGHTS. SOME JURISDICTIONS DO NOT PERMIT CERTAIN EXCLUSIONS, SO THEY APPLY ONLY TO THE EXTENT LAWFUL.

21. INDEMNIFICATION

To the extent permitted by law, you agree to defend, indemnify, and hold harmless RandomSaga and its personnel from third-party claims, losses, liabilities, and reasonable expenses, including reasonable attorneys' fees, arising from your unlawful User Content, your submission of prohibited real-world or non-AI imagery, infringement of another person's rights, unauthorized use or disclosure of API keys, your unlawful or unauthorized use of a third-party AI service, or your material breach of these Terms. This obligation does not apply to the extent a claim results from RandomSaga's own wrongdoing or where prohibited by law. We will provide reasonable notice of a covered claim and may participate in its defense at our own expense.

22. DISPUTES, GOVERNING LAW, AND JURISDICTION

These Terms and any dispute arising from them are subject to the laws that apply under the relevant jurisdiction's conflict-of-laws rules, including any mandatory consumer-protection laws. Any legal proceeding may be brought in a court of competent jurisdiction as permitted by applicable law. These Terms do not restrict access to courts or statutory remedies that cannot lawfully be limited.

Before initiating formal proceedings, we encourage you to contact support@randomsaga.com to seek an informal resolution. This request does not require anyone to waive urgent legal remedies or statutory rights.

23. CHANGES TO THESE TERMS

We may revise these Terms to reflect changes in the Service, operations, safety practices, or applicable law. We will post the revised version with a new "Last Updated" date and provide additional notice or obtain consent if required by law. Changes will apply prospectively as specified in the notice. If you do not accept updated Terms, stop using the Service. Continued use after legally effective notice may constitute acceptance to the extent permitted by applicable law.

24. GENERAL TERMS

If any provision is held unenforceable, the remaining provisions remain effective to the extent permitted by law. Our failure to enforce a provision is not a waiver of the right to enforce it later. You may not transfer these Terms without our written consent; we may transfer them in connection with a lawful merger, sale, reorganization, or business transfer, subject to applicable law and privacy obligations. These Terms, together with expressly incorporated policies and applicable purchase-specific terms, constitute the agreement concerning the Service and supersede prior understandings on the same subject.
